Starrise Contacts – Terms of Service

Welcome to Starrise Contacts. These Terms of Service (“Terms”) govern your use of the Starrise Contacts mobile application (the “App”). By downloading, installing, or using the App, you agree to be bound by these Terms.
1. About These Terms
1.1 Agreement to Terms
By accessing or using Starrise Contacts, you confirm that you accept these Terms and agree to comply with them. If you do not agree with any part of these Terms, you must not use the App.
1.2 Who May Use the App
The App is intended for users who are at least 4+ years of age. By using the App, you represent and warrant that you meet this age requirement. This age my differ depending on the country you are located in.
1.3 Key Definitions
Throughout these Terms:
- “We,” “us,” or “our” refers to Coinlex, Thaiss GbR, a company organized under the laws of Germany
- “You” or “your” refers to you as the user of the App
- “App” refers to the Starrise Contacts mobile application
- “Services” refers to all features, functionality, and content provided through the App
- “Pro Subscription” refers to the premium subscription service offering enhanced features
2. Use of the App
2.1 License Grant
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on devices that you own or control, solely for your personal, non-commercial purposes.
2.2 Restrictions
You agree not to:
- Modify, adapt, or create derivative works of the App
- Reverse engineer, decompile, or disassemble the App
- Remove, alter, or obscure any proprietary notices on the App
- Use the App for any unlawful purpose or in violation of these Terms
- Attempt to gain unauthorized access to any portion of the App or related systems
2.3 Your Data
The App accesses your device’s Contacts to provide its core functionality. We do not store, collect, or transmit your contact information to our servers. All contact data remains on your device and is subject to Apple’s privacy and security measures. For more information about data handling, please refer to our Privacy Policy.
3. Pro Subscription
3.1 Subscription Features
The App offers an optional “Starrise Contacts Pro” subscription that unlocks premium features, including but not limited to advanced notification capabilities, business card scanning, and AI-powered note analysis.
3.2 Billing and Payment
- Subscriptions are available on a monthly or annual basis
- Payment will be charged to your Apple ID account at confirmation of purchase
- All transactions are processed through the Apple App Store
- Prices are determined by Apple and may vary by region
- We do not have access to your payment information
3.3 Automatic Renewal
Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price you initially paid.
3.4 Managing Your Subscription
You can manage your subscription and turn off auto-renewal by visiting your Apple ID Account Settings after purchase. Subscriptions may also be managed through the App’s settings interface.
3.5 Cancellation Policy
You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. No refunds will be provided for the unused portion of any subscription period.
3.6 Price Changes
We reserve the right to modify subscription pricing at any time. Price changes will not affect your current subscription period and will only apply upon renewal. We will provide reasonable advance notice of any price changes.
3.7 Refunds
All subscription purchases are final. Refund requests must be directed to Apple through the App Store, as we do not process refunds directly.
4. Third-Party Services and Content
4.1 External Links
The App may contain links to third-party websites, services, or resources. We do not endorse and are not responsible for the availability, accuracy, content, or policies of these third-party resources. Your use of third-party services is at your own risk and subject to their terms and policies.
4.2 Third-Party Integrations
The App may integrate with third-party services such as mapping applications, AI services, or analytics platforms. Your use of these integrations is subject to the respective third party’s terms of service and privacy policies.
5. Intellectual Property
5.1 Ownership
The App, including all content, features, functionality, and intellectual property rights therein, is owned by Coinlex, Thaiss GbR, our licensors, or other providers of such material. The App is protected by copyright, trademark, and other intellectual property laws.
5.2 Trademarks
“Starrise Contacts” and associated logos are trademarks of Coinlex, Thaiss GbR. You may not use these trademarks without our prior written consent.
6. Disclaimer of Warranties
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- Warranties of merchantability, fitness for a particular purpose, and non-infringement
- Any warranties that the App will be uninterrupted, error-free, or free from harmful components
- Any warranties regarding the accuracy, reliability, or completeness of content
- Any warranties that defects will be corrected
We do not guarantee that the App will meet your requirements or that it will be compatible with all devices or operating system versions.
Some jurisdictions do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
7.1 Damages Cap
Our total liability to you for all claims arising from or related to the App or these Terms will not exceed the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) €100.
7.2 Excluded Damages
We will not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Loss of profits, revenue, or business opportunities
- Loss of data or contacts
- Business interruption
- Loss of privacy
- Failure to meet any duty of care
This limitation applies regardless of the legal theory (contract, tort, negligence, strict liability, or otherwise) and regardless of whether we were advised of the possibility of such damages.
7.3 Jurisdictional Limitations
Some jurisdictions do not allow limitations on liability for incidental or consequential damages. In such jurisdictions, our liability will be limited to the maximum extent permitted by law.
8. Your Responsibilities
8.1 Account Security
You are responsible for maintaining the security of your Apple ID and any account-related credentials. You agree to notify us immediately of any unauthorized access to your account.
8.2 Acceptable Use
You agree to use the App in compliance with all applicable laws and regulations. You will not use the App to store, process, or transmit any content that is illegal, offensive, or infringes on the rights of others.
8.3 Backup
You are solely responsible for backing up your device and data. We recommend regularly backing up your device through iCloud or other backup services.
9. Termination
9.1 Termination by You
You may stop using the App at any time by deleting it from your device. To cancel your subscription, follow the instructions in Section 3.4.
9.2 Termination by Us
We reserve the right to suspend or terminate your access to the App at any time, with or without notice, for any reason, including if we believe you have violated these Terms.
9.3 Effect of Termination
Upon termination:
- Your license to use the App immediately ceases
- You must delete all copies of the App from your devices
- Any outstanding payment obligations survive termination
- Sections of these Terms that by their nature should survive termination will remain in effect
10. Updates and Changes
10.1 App Updates
We may release updates to the App from time to time. These updates may include new features, bug fixes, or security patches. Some updates may be required to continue using the App.
10.2 Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by:
- Posting a notice in the App
- Updating the “Last Updated” date at the top of these Terms
- Sending a notification through the App or to your device
For material changes, we will provide at least 30 days’ notice before the changes take effect. Your continued use of the App after the effective date constitutes acceptance of the revised Terms.
11. Dispute Resolution and Governing Law
11.1 Governing Law
These Terms are governed by and construed in accordance with the laws of Germany, without regard to its conflict of law provisions.
11.2 Informal Resolution
Before initiating any formal proceedings, you agree to first contact us at support@coinlex.com to attempt to resolve any dispute informally.
11.3 Jurisdiction
Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of Germany.
12. Miscellaneous
12.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App and supersede any prior agreements.
12.2 Severability
If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
12.3 Waiver
Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.
12.4 Assignment
You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign these Terms without restriction.
12.5 No Third-Party Beneficiaries
These Terms do not create any third-party beneficiary rights.
12.6 Force Majeure
We will not be liable for any delay or failure to perform resulting from causes outside our reasonable control.
